Payment will be made in arrears after the completion of each order. The government will make payment in accordance with the prompt payment act and prompt payment regulations.

The contractor warrants and implies that the items delivered under this contract are merchantable and fit for use for the particular purpose described in this contract.

The government will award a firm-fixed-price contract to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the government, price and other factors considered.

Offerors must be registered in the System for Award Management (SAM) database at the time of quote submission and at the time of award.

Site visit is not scheduled at this time.

In the event of the contractor's or a subcontractor's noncompliance with the clause addressing DEI discrimination, this contract may be canceled, terminated, or suspended in whole or in part, and the contractor or subcontractor may be declared ineligible for further government contracts.

Quotes must be submitted any time prior to 1:00 PM on July 31, 2026.

The town agrees to make all reasonable efforts to pay the contractor within thirty (30) days of receipt of an invoice detailing the work completed and acceptance from the town of the work completed.

The awarded contractor guarantees that all materials incorporated into the work will be new unless otherwise specified or agreed. The contractor agrees to make, at their own expense, any repairs or replacements made necessary by defects in materials or workmanship supplied to them that become evident within one (1) year after the date of the final payment.

The town will award the contract to the lowest responsive and responsible submitter.

Submitter must provide a minimum of three (3) references for whom they have completed contracts for work similar in size and scope to this project within the last five (5) years.

Questions regarding the project must be addressed in writing by 1 PM on July 24.

Any employee found on a worksite without documentation of successful completion of a 10-hour OSHA-approved construction safety and health course shall be subject to immediate removal.
