Proposals must be submitted by August 13, 2026, at 3:00 PM.

Progress payments will be made on or about the 15th of each month, covering 90% of the contract sum allocable to labor, materials, and equipment incorporated in the work, and 90% of materials suitably stored. Final payment is made after substantial completion and submission of required documentation.

The performance bond shall guarantee the repair and maintenance of all defects due to faulty materials and workmanship that appear within one year from the date of substantial completion.

The successful bidder will be selected based on project cost (50%), reputation of the vendor and vendors related experience (35%), and estimated time of completion (15%). Lowest price may not necessarily be the primary criteria of selection.

The City may make investigations to determine the ability of the offeror to perform the work and reserves the right to reject any proposal if the evidence fails to satisfy the City that the offeror is properly qualified.

If a specified material or color cannot be delivered by the contract completion date due to failure to order in a timely manner, the contractor will be responsible for supplying an equal or better material and will be charged an amount equal to 5% of the value of the specified material.

A mandatory pre-proposal conference will be held on August 6, 2026, at 10:00 AM, where the facilities superintendent will be available to escort bidders to the site locations for inspection.

All requests for clarification must be submitted no later than August 10, 2026, at 10:00 AM.

Causes for disqualification include failure to attend the mandatory prebid meeting, evidence of collusion, lack of responsibility, lack of expertise, uncompleted work under other contracts, being in arrears on existing contracts, or failure to comply with submittal requirements.

Proposers must demonstrate organizational capability and experience in developer-led brackish groundwater desalination projects, including financing, permitting, design, construction, and long-term operations. The lead entity must have operated continuously for a minimum of five years, preferably in the United States. The ice skating rink must be installed in advance and fully operational for the scheduled season running Saturday, November 28, 2026 through Sunday, January 3, 2027. Installation can start no earlier than Monday, November 9, 2026. Final removal and demobilization should be complete by January 11, 2027.

Payment terms are net 30 days after each delivery of goods and/or services are completed as required or a correct invoice is received, whichever is later.

The contractor warrants that all products supplied are new, quality items free from defects, fit for their intended purpose, and of good material and workmanship. Products are warranted by the contractor or manufacturer for the period stated in Attachment D.

The award will be made to the bidder whose bid is determined to be the best value for the city, based on demonstrated experience (40%), quality of past performance and references (20%), and bid pricing (40%).

Bidders must have operated continuously for a minimum of five years providing ice skating rink rental services and must provide documentation demonstrating this experience. They must also not have any outstanding lawsuits or regulatory issues that could materially affect their ability to provide the services.

In the event of equipment failure or inability to maintain skateable ice, the contractor is allowed up to three consecutive days of non-operation without penalty. Beginning on the fourth day of contractor-controlled downtime, liquidated damages of $500 per day may be assessed.
