McDuffie County Board of Commissioners is seeking bids for the construction of a median cut on Industrial Park Drive in Thomson, GA. The project includes grading, paving, and concrete curbs. The bid notice states that invoices shall be submitted electronically to ***@***. *. * terms are 20 days for ACH and 30 days for paper check. Progress payments will be made in an amount equal to 95% of the work completed prior to substantial completion.
The contractor agrees to warrant and assume responsibility for all products for a period of one year, unless otherwise specified. This includes that the product will do what was said, live up to all specific claims, be suitable for ordinary and special purposes, be properly designed and manufactured, and be free of significant defects or unusual problems.
The county reserves the right to reject any and all bids, to waive any and all informalities, and to disregard nonconforming, nonresponsive, or conditional bids. The project will be awarded by the county pursuant to applicable law. McDuffie County also reserves the right to make an award to a bidder with a business license in McDuffie County in lieu of the lowest bid received, provided the bid is not more than 4% of the lowest bid.
McDuffie County may make any investigations deemed necessary to determine a bidder's ability to perform the work. The county reserves the right to reject any bid from any bidder that the county considers not properly qualified to carry out agreement obligations or able to satisfactorily complete the work on schedule. Bidders must also provide a completed copy of all provided county forms and documents, including a business license and contractor's license.
If the contractor neglects, fails, or refuses to complete the work within the time specified, or any proper extension thereof granted by the county, the contractor agrees to pay the county $300 for each and every calendar day that the contractor shall be in default after the time stipulated in the contract for completing the work, as liquidated damages.

The contractor shall give written notice to the County Manager of intent to file a claim for money or other relief within ten (10) calendar days of the occurrence giving rise to the claim or at the beginning of the work upon which the claim is to be based, whichever is earlier. The claim, with supporting documentation, shall be submitted to the County Manager by US mail, courier, or overnight delivery service, no later than sixty (60) days after final payment.
