Bid for the purchase and reconditioning of
athletic football helmets, with specifications for various brands, models, colors, and sizes. Bids must be returned by mail or in person, not by email or fax. Bid prices must be firm for at least 30 days from the opening date. The bidder is responsible for ensuring timely delivery to the university's physical location. Additional documents may be required for bids that differ from the requested brand, model, or style. The university reserves the right to award items separately, in groups, or on an all-or-none basis. The initial order is expected to be placed on or near July 1, 2025, and must arrive before July 15, 2025, unless mutually agreed upon in writing. All other orders should have the shortest possible ship date. The awarded vendor must provide manufacturers documentation or proof of authorization for reconditioning services. Bid prices must include all delivery charges, paid by the vendor, F. O. B. destination. Bids in excess of $50,000 require a bid bond guaranteed by a surety company qualified to do business in Louisiana, for 5% of the bid amount. Payment is due within 30 days after receipt of a properly executed invoice or delivery, whichever is later. Bidders must comply with all instructions to bidders, terms, conditions, and specifications. The bid must be manually signed in ink by an authorized representative. All bids must be submitted on the designated bid forms. The university is exempt from all Louisiana state and local sales and use taxes. The contract may be renewed for two additional one-year terms if both parties agree. The university reserves the right to cancel the contract under certain conditions, including failure to deliver within the specified time, failure of the product or service to meet specifications, misrepresentation by the vendor, fraud, or other unlawful means. The university has the right to cancel the contract for convenience by giving 30 days written notice. All contracts shall be construed in accordance with and governed by the laws of the state of Louisiana. The bidder must certify that the bid is made without collusion or fraud. Any qualified individual with a disability who desires to attend the bid opening must notify the university in writing not later than seven days prior to the bid opening date. The contractor agrees to indemnify the state, its officers, agents, and employees from claims for bodily injury, death, or property damages caused by the contractor's fault. The state reserves the right to reject a proposal or bid form, or not award the contract to, a business in which any individual with an ownership interest of 5% or more has been convicted of, or has entered a plea of guilty or nolo contendere to, any state felony or equivalent federal felony crime committed in the solicitation or execution of a contract or bid. The continuation of this contract is contingent upon the appropriation of funds. For each contract in excess of $25,000 per project, the public entity shall require of the contractor a bond with good, solvent, and sufficient surety in a sum of not less than 50% of the contract price for the payment by the contractor or subcontractor to claimants. The bidder must be fully qualified under any state or local licensing law for contractors in effect at the time and at the location of the work. No public servant, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
