If the contractor fails to deliver any first article on time, or the contracting officer disapproves any first article, the contractor shall be deemed to have failed to make delivery within the meaning of the default clause of this contract.
Samples are not returned to the contractor because they shall be destroyed during testing. For first article testing, samples are to be unpainted, with corrosive areas coated with a light preservative. This paragraph does not apply to shipping containers.
