The city may require any and all bidders to present evidence of experience, ability and financial standing as well as a statement as to the equipment which the bidder will have available for the execution of this contract. Bidders shall maintain a sufficient stock level to ensure delivery within five working days from order placement.

The vendor shall submit an invoice for payment on a monthly basis for those products and services as described in schedule a. payment shall be made upon approval of invoice and reconciling delivery tickets.

All tires shall be guaranteed as provided by the manufacturer.

The award shall be made to the responsive, responsible vendor submitting the lowest overall cost whose tires meet or exceed all of the specifications listed.

A responsible bidder is a manufacturer, producer, dealer, vendor, or bona fide manufacturers agent. . . who has demonstrated judgment and integrity, is of good reputation, experienced in his work, whose record of past performance in the trade is established as satisfactory, and whose financial status is such to provide no risk to the city of poughkeepsie in its contractual relations.

Failure on the part of the successful bidder to comply with terms of the contract and specifications as set forth herein, may result in termination of the contract.

Samples may be requested by the city for the purpose of product evaluation. it is understood that samples will be provided at no charge to the city and will be returned, when requested, within 30 days after the evaluation is completed, at the expense of the vendor.

Bidders on the contracts are required to execute a noncollusion bidding certificate pursuant to section 103d of the general municipal law of the state of new york.
