The contractor shall substantially complete the work by December 16th of the current contract year after the Village's issuance of the notice to proceed, provided all bonds and insurance certificates are furnished. The contractor agrees to complete the work in totality within 30 days after the date of substantial completion.
The Village shall pay for services based on unit pricing and quantities used, in accordance with the Local Government Prompt Payment Act. Invoices detailing services provided should be submitted directly to the Village, referencing the appropriate purchase order number. Payments may be subject to deduction or set-off due to contractor failure to perform. Final payment is contingent upon full performance, delivery of warranties, and a release of all liens or a satisfactory bond.
The work, and all of its components, shall be of merchantable quality, free from defects, and conform to specifications. The contractor shall promptly and without charge correct any failure to fulfill this warranty within one year after final payment, or longer if prescribed by performance standards or law. This warranty period is extended for repaired or replacement parts and labor.
Award shall be made to the lowest responsive and responsible bidder as determined by the Village. Responsibility may be evaluated based on the ability to provide experienced labor, conformity with specifications, serviceability, quality, and financial capability.
The successful bidder must be qualified to perform the work and demonstrate experience in accordance with bid specifications. Criteria include compliance with specifications, past performance, bid submission requirements, current work, references, and no debarment or ineligibility for public contracts. Bidders must provide at least three comparable projects completed in the past five years.
Failure to achieve substantial completion by the required date may result in liquidated damages, calculated per day of delay based on a schedule in the Illinois Department of Transportation Standard Specifications for Road and Bridge Construction. The Village may also deduct costs for correcting deficiencies or obtaining substitute items/services if the contract is terminated due to contractor breach or default.
Each bidder shall visit the sites of the proposed work and fully acquaint himself with conditions, as they exist, and shall undertake such additional inquiry and investigation as he shall deem necessary.
Bidders may be disqualified for conviction of bribery, bid rigging, bid rotating, price fixing, or defrauding a government entity. Failure to disclose potential or actual conflicts of interest, or contacting municipal personnel outside designated channels, can also lead to disqualification. Non-compliance with bid submission requirements or addenda may result in rejection.
