The contract will be awarded in accordance with statutes governing such contracts in accordance with Massachusetts General Laws chapter 30 39m.

Bidders must be prequalified by the department in the mowing and spraying category to bid on the above project.

The project value is 1, 650, ****.

The construction covered by the contract documents shall be substantially completed within 20 consecutive calendar days from the date specified in the notice to proceed issued by the city of lubbock to the successful bidder.

All payments due to contractor shall be made in accordance with the provisions of the general conditions of the contract documents.

All equipment and materials incorporated in the project and all construction shall be guaranteed against defective materials and workmanship.

Selection shall be based on the responsible bidder whose bid is determined to be the most advantageous to the city of lubbock considering the relative importance of evaluation factors included in this itb.

The bidder may be required before the award of any contract to show to the complete satisfaction of the city of lubbock that it has the necessary facilities, ability, and financial resources to provide the service specified therein in a satisfactory manner.

The contractor shall forfeit as a penalty to the city of lubbock on whose behalf this contract is made, sixty dollars for each laborer, workman, or mechanic employed for each calendar day, or portion thereof, such laborer, workman or mechanic is paid less than the wages assigned to his particular classification as set forth in the schedule of general prevailing rate of per diem wages included in these contract documents.

It shall be each bidders sole responsibility to inspect the site of the work and to inform bidder regarding all local conditions under which the work is to be done.

All protests regarding the itb process must be submitted in writing to the city director of purchasing and contract management within 5 working days after the protesting party knows of the occurrence of the action which is protested relating to advertising of notices deadlines, bid opening and all other related procedures under the local government code, as well as any protest relating to alleged improprieties with the itb process.

The terms and time for payment are set forth in the agreement.

The owner may award the contract as a whole or in parts to one or more successful bidders.

The owner is not obligated to consider a bidders proposal, if the bidder does not meet the following criteria: 1. valid proof of insurance, equal to or exceeding the owners requirements. 2. list of three references where the bidder has performed similar work. do not include the owner as one of the references. 3. provide a list of equipment to be used for the project, as stated in attachment 1, a. 7. ii. 4. the contractor must be able to bond 100 of the cost of the submitted bid, through a surety company with the qualifications listed below.
