Phase A is to be substantially complete in 120 days from the notice to proceed, and finally complete in 150 days. Phase B is to be substantially complete on or before May 14, 2027, with final completion within 30 days of substantial completion.

Progress payments will be made monthly, with 95% of work completed and 95% of materials and equipment costs paid, less retainage. Final payment will be made within sixty 60 days after the contract is completed satisfactorily and finally accepted by the owner.

Contractor warrants and guarantees to owner and engineer that all work will be in accordance with the contract documents and will not be defective within two years of substantial completion or such longer period of time in accordance with paragraph **** of the standard general conditions of the construction contract section c700.

In evaluating bids, owner shall consider the qualifications of the bidders, whether or not the bids comply with the prescribed requirements, alternates and unit prices if requested in the bid forms. Owner reserves the right to reject any and all bids, to waive any informalities or technicalities, and to negotiate contract terms with the successful bidder.

Each bidder must submit written evidence of their qualifications to perform the work by executing the attached bidder evaluation criteria form. Bidders may be required to submit evidence that they have practical knowledge of the particular work bid upon, and that they have the financial resources to complete the proposed work.

Contractor shall pay to the owner, as liquidated damages and not as a penalty, $1,**** per day for each day of delay in completing all or any designated portion of the work within the time set forth in the agreement. The aggregate liability for liquidated damages shall not exceed 50% of the contract price.

It is the responsibility of each bidder to visit the site to become familiar with local conditions that may affect the cost, progress, performance, or furnishing of the work. On request in advance, owner will provide each bidder access to the site to conduct such explorations and tests as each bidder deems necessary.

No right to claim mistake shall exist for bidder following the twenty-four 24 hour period after the bid opening.

If a bidder withdraws their bid after the 24-hour period following bid opening due to a material and substantial mistake, they will be disqualified from further bidding on the work of this contract.

The project aims for full completion by the end of September 2026, with a specific deadline of no later than September 30, 2026.

Contractor shall submit a detailed invoice by the 15th of each month for work performed in the previous calendar month. The total not-to-exceed sum for the project is $XX,XXX. 00.

The town shall rank each applicant based on its written proposal, using a rating scale from 1 to 5 for criteria including scope of proposal, qualifications, motivation, and firm capability. The award may be based on written evaluations and/or interviews.

Proposals must include a brief description of the company, experience in relation to the project, financial information, product information, management arrangement, fee proposal, and example agreement. Firms must also provide relevant electrical license numbers and accreditations.

Questions concerning the scope of the bid or submittal process must be submitted in writing via email no later than June 29, 2026, by 5:00 PM MST.

No proposal shall be accepted from, and no contract will be awarded to, any person, firm, or corporation that is in arrears to the Town of Windsor upon debt or contract, is a defaulter, or is deemed irresponsible or unreliable by the Town.

Proposals must be received no later than July 2, 2026, by 2:00 PM MDT. The project completion deadline is September 30, 2026.

Bids are due by Friday, June 26th, 2026, at 12:00 PM Mountain Standard Time.

The contractor shall provide a minimum warranty period of 2 years for workmanship and a warranty equal to the manufacturer's warranty.

The contract will be awarded to the lowest bidder whose evaluation indicates the award will be in the best interest of the project, considering qualifications, responsiveness, and financial ability.

Bidders must demonstrate successful completion of three municipal projects of similar size and scope within the past five years and have been in business for at least five years. They may also be required to submit a bidder evaluation form.

A field site visit will be conducted following the mandatory pre-bid meeting for all attendees participating in person.

Failure to comply with bid requirements, including bid security, or declining to make a requested subcontractor substitution may lead to disqualification or forfeiture of bid security.
