The proposed contract shall include assessed penalties or liquidated damages for material breaches, service failures, nonperformance, or repeated failure to meet performance standards.

The protest period follows the notice of intent to award, with formal written protests to be filed within ten calendar days of the notice date.
Factors such as evidence of collusion, attempting to improperly influence staff, default under a previous agreement, unresolved litigation with the borough, or delinquency in paying borough taxes or fees may disqualify a proposal.
