The contractor shall notify the VA prosthetic representative and show cause in the event they are unable to deliver the required items in accordance with the government's required delivery date. For emergency services, delivery targets vary by zone, with Zone A requiring delivery within 4 business hours after notification by VA.

Payment by District shall be made within thirty (30) days of acceptance by District of each accurate and undisputed invoice submitted for payment.

The offeror must offer product warranty of at least one (1) year and services warranty of at least ninety (90) days.

This solicitation is being conducted as a best value procurement, where the district evaluates proposals based on a combination of price and non-price factors, such as past performance and other criteria specified in the solicitation. The district is not required to award the contract to the lowest-priced offeror or the offeror with the highest technical score.

The offeror must meet all required qualifications as outlined in Section 5 Pass/Fail Evaluation, including meeting Centers for Medicare & Medicaid Services (CMS) DMEPOS state licensure requirements, being accredited by a CMS approved accrediting organization, and maintaining at least one CMS contract award for specific product categories.

The following performance metrics must be met, or offeror may be subject to penalties as set forth in Schedule B Pricing, hereof: maintain a ninety-eight percent (98%) in-stock performance base on orders and/or prescriptions filled on any given business day, deliver all requested products to hospital and hospital extensions within two (2) hours of request, and deliver all requested products to non-hospital at home patient homes within twenty-four (24) hours of request.
