Vendors must be qualified to provide fresh baked goods and meet minimum specifications. The district will consider experience, skill, ability, financial capacity, integrity, and previous experience. The experience, skill, ability, business judgment, financial capacity, integrity, honesty, possession of the necessary facilities and equipment, bonding, previous experience, reputation, promptness, and the estimated completion or delivery time of all vendors shall be taken into consideration in the awarding of the contract.

Vendors must provide reliable data and references for investigation if their competency is questioned. A valid food establishment permit or health permit is required. If the vendors are unknown to the school district or their competency questioned, it shall be understood that they will, upon request, file with the school district, reliable data and references for investigation as deemed necessary to determine the ability of the vendor to provide the contents of this solicitation.

In case of default by the vendor, the district may cancel the contract and repurchase from another source, recovering excess costs.
