Bid submissions will be received through the bidnet directs California Purchasing Group website until 2:30 p. m. on Tuesday, June 9th, 2026.

The City shall retain 5% of the estimated value of the work done and materials on hand, and shall monthly pay to the contractor the balance not retained, after deducting all previous payments and all sums to be kept or retained under the provisions of the contract.

The contractor shall guarantee all materials, equipment and workmanship of the installation. Should any material or application or any work develop any defect or weakness due to the use of imperfect materials, equipment or workmanship, or failure to follow the plans and specifications, the contractor shall be notified at once, and he shall immediately, at his own expense, make the necessary repairs or replacements to make the defective item or items suitable and satisfactory.

The contract will be awarded to the lowest responsible bidder whose proposal complies with all the requirements prescribed.

Bidders shall certify that he is, at the time of bidding, and shall be throughout the period of the contract, licensed under the provisions of Chapter 9, Division 3 of the Business and Professions Code of the State of California to do the type of work contemplated in the project manual. The bidder shall further certify that he is skilled and regularly engaged in the general class and type of work called for in the project manual.

Contractors shall forfeit two hundred dollars (****) to the City for each calendar day or portion thereof, for each worker paid less than the prevailing wage rates.

The bidders shall carefully examine the site of the work contemplated, and the proposal, plans, specifications, and contract forms, therefore. It will be assumed that the bidder has investigated and is satisfied as to the conditions to be encountered regarding character, quality, and quantities of work to be performed and the materials to be furnished, and as to the requirements of the specifications, the special provisions, and the contract.

Before any contract is awarded, the bidder may be required to furnish a complete statement of the origin, composition and manufacture of any and all materials to be used in the construction of the work together with samples, which may be subjected to the tests provided for in the specifications to determine their quality and fitness for the work.

All questions regarding this project shall be in writing and shall be submitted through bidnet, no later than 4:00 p. m. on Tuesday June 2, 2026.

More than one proposal from an individual, a firm or partnership, a corporation or combination thereof under the same or different names will not be considered. Reasonable grounds for believing that any bidder is interested in more than one proposal for the work contemplated will cause the rejection of all proposals in which such bidder is interested. If there is reason for believing that collusion exists among the bidders, none of the participants in such collusion will be considered in future proposals. Proposals in which the prices obviously are unbalanced may be rejected.

The anticipated start date for the project is Tuesday, September 01, 2026, and final completion by Monday, November 02, 2026.

Owner shall pay contractor for performance of the work in accordance with the contract documents in current funds as shown in exhibit a: proposal. Progress payments will be made on the basis of the progress of the work, the amount of which will be decided by the engineer. Progress payments will be made in accordance with state act 524.

Contractor warrants and guarantees to owner and engineer that all work will be in accordance with the contract documents and will not be defective. If within two 2 year after the date of substantial completion, or such longer period of time as may be prescribed by law or by the terms of any applicable special guarantee required by the contract documents or by any specific provision of the contract documents, any work is found to be defective, contractor shall promptly, without cost to owner, and in accordance with owners written instructions, either correct such defective work or, if it has been rejected by owner, remove it from the site and replace it with nondefective work.

The owner and engineer will further assess the bids based on the following criteria: 1. Cost effectiveness 2. Similar past project experience 3. Ability to complete project within timeframes.

To demonstrate qualifications to perform the work, each bidder must be prepared to submit within five 5 days of owners or engineers request, written evidence of any information deemed necessary by the engineer for bid evaluation, including, but not limited to, financial data, previous experience, evidence of authority to conduct business in the jurisdiction where the project is located or covenant to obtain such qualification prior to award of the contract.

Owner and contractor agree that as liquidated damages for delay but not as a penalty contractor shall pay owner, city of belleville, 500 for each day that expires after the time specified in paragraph 3. 1 for completion until the work is completed.

Before submitting a bid, each bidder must visit the site to familiarize itself with local conditions that may, in any way, affect cost, progress or performance of the work.

Contractor also shall submit to engineer for review, with such promptness as to cause no delay in work, all samples required by the contract documents.

The deadline for request for information RFI is Tuesday, June 02, 2026, 10 am EST.

Failure to submit any such data within the five 5 day period shall give the owner and the engineer the right to finally reject the contractors bid.

Sealed bids must be received by the Town Clerk of the Town of Cortlandt no later than 10:00 AM prevailing time on June 4, 2026.

The contract documents state that progress payments will be made within thirty (30) days of verification and approval by the engineer, with a five (5) percent retention until work is virtually complete.

The contractor guarantees all work constructed or performed against defects in material or workmanship for a period of two (2) years from the date of approved acceptance of the work performed under this contract.

The contract shall be awarded to the lowest responsible bidder based on the cumulative number of the base bid.

All work shall be done by a contractor who has the necessary facilities, plant and equipment in good working order, a competent organization and special experience in work of a similar type to that specified herein. No bid will be accepted from any contractor who is not engaged in the respective business on a full-time basis and has not been engaged in the respective trade for at least five (5) years.

The document mentions that flagrant disregard of the specifications will constitute just cause for termination of the contract and payment of any just claims incurring therefrom.

A non-mandatory pre-bid conference is scheduled for 1:00 PM, Wednesday, May 27, 2026, at the Town Hall.
