Lot 1: The KY Department of Education, Division of School and Community Nutrition ( SCN) is responsible for administering the Child Nutrition Programs for the United States Department of Agriculture. SCN is seeking a qualified professional organization to assist the State Agency in the area of oversight for the Summer Food Service Program ( SFSP), to ensure State Agency compliance. Various types of sponsors participate in the program, which includes private non- profit organizations, public schools, camps, and government organizations. Approximately 170 sponsors receive technical assistance, training and reimbursement of approximately $ 47 million annually in program expenditures.

Lot 1: 34 CFR ****- 153 and 707 KAR 1: 340, Section 8 requires the Kentucky Department of Education to, within sixty ( 60) days, resolve state complaints alleging a local education agency has violated a requirement of Part B of the Individuals with Disabilities Education Act ( IDEA). The purpose of this RFP is to award multiple contracts to individuals and/or companies to provide the services listed in Section 2. 00 Scope of Work. All contract awards will not have a guarantee of work for any vendor awarded from the RFP.

Lot 1: The Kentucky Department of Education ( KDE) is seeking a qualified individual or company to assist KDE in the continuation of the Medicaid School- Based Administrative Claiming ( SBAC) Program and upon approval of Kentucky Department of Medicaid Services ( DMS) State Plan Amendment, the Random Moment Time Study ( RMTS) shall include Free Care. Random Moment Time Study; is a tool used by the School- Based Medicaid Program to measure what a person is doing during a moment of time of the workday. The SBAC provides a method of federal reimbursement for a portion of health- related administrative outreach activities currently performed by KYs 173 school Local Education Agency ( LEAs) that serve the states 646, 936 public school students, the KY School for the Deaf and the KY School for the Blind. Of these 173 LEAs, 161 were certified to provide direct school- based health services in 2018- 2019. In fiscal year 2019, 667, 208 of children under the age of 20 were eligible Medicaid recipients. Of these 529, 734 were under fifteen ( 15); 85, 267 were between fifteen ( 15) and seventeen ( 17; and 52, 207 were between eighteen ( 18) and twenty ( 20). Free Care allows all students who qualify for Medicaid services to receive services at school without the requirement of an IEP. Free Care precludes Medicaid from paying for the costs of Medicaid coverable services and activities which are generally available to all students without charge, including reimbursement for Section 504 services or general health care services blend working Centers for Medicare and Medicaid Services CMS indicated that schools were legally liable and responsible for providing and paying for these services. KDE has been actively participating in this Medicaid Reimbursement program since ****.

Lot 1: Kentucky has a two- tiered process in which a hearing officer, trained and certified by the state, conducts a hearing and renders a decision. If the parents or Education Entity disagree with the hearing officers decision, they may request a review of the decision by a three member Exceptional Children Appeals Board ( ECAB). The ECAB members are also trained and certified by the state. The KDE anticipates a need for six ( 6) qualified individuals to serve as ECAB members. While serving on the ECAB, successful candidates will receive $ 125 per hour of service and reimbursement for authorized expenses, including necessary travel. Successful candidates will complete KDE provided training as directed by KDE and receive $ 500 per day for training, not to exceed $ 2, 500 per calendar year. Successful candidates will not receive $ 125 per hour for completing training required by KDE. ECAB members may be appointed by KDE to serve as due process hearing officers. Persons serving in this capacity will receive compensation from the Education Entity at the rate of $ 125 per hour under a contract with the Education Entity to render the following services: conduct pre- hearing conferences; prepare correspondence; conduct due process hearings; review evidence and testimony; and engage in legal research and preparation of the written decision. The Education Entity will reimburse persons serving in this capacity for travel and other miscellaneous expenses as authorized by the policy of the Education Entity. The vendor may also be assigned to investigate and decide IDEA formal complaints pursuant to 34 CFR ****- 153. The compensation rate of $ 125 per hour is commensurate with the rate of pay for hearing officers within the Office of the Attorney General as contracted to other state agencies.
