The executive director may hire a testing laboratory to determine if the materials conform to the original polymer specifications. If the specifications are not met, the materials will be rejected and the cost of testing and polymer removal from the equipment will then be paid for by the contractor. In the event the polymer supplied under the contract fails to perform, the pvsc reserves the right to return the unused polymer to the supplier, place the supplier in default, or take other actions in the best interest of the pvsc. The supplier will have the option to switch to another polymer at no additional cost to the pvsc above the current cost of polymer if he can not correct the problem within 48 hours of notice by pvsc. Any removal cost to pump out the unused liquid polymer into a tank truck shall be the suppliers responsibility, along with supplying the equipment. The manufacturer who supplies the polymer may be required to provide on site training on the operation with his polymer with pvsc operators and supervisors. pvsc will determine time frame for training. The polymer shall remain stable once introduced to the flow and not generate any polymer based odors. pvsc will be determining factor when an odor is present. The vendor will be required to take immediate action with 24 hours of notification to correct this problem. If the polymer conditioned sludge, causes odor problems, the supplier will be responsible for any removal costs associated with the polymer on site. The supplier will also be responsible for any fines that may be generated by any agency because of these odor problems. This includes the disposal site, hauler and pvsc.
