The Township of South Brunswick is inviting bids for the sale of radio towers, cell radio communications antennae colocation leases, and permanent easements. Bids must be submitted by December 18, 2025, at 11:00 AM. The contract will be awarded to the bidder whose product is judged to best serve the interests of the township when price, product, and service are all considered. The buyer has a 30-day due diligence period after the notice of bid acceptance. The township will warrant that the lease agreements are valid and enforceable. The buyer must maintain commercial liability insurance coverage of at least $5,000,000 for bodily injury/property damage.
The closing shall be scheduled to occur within thirty 30 days of the expiration of the due diligence investigation period, according to the bid notice.
The bid price is to be paid to the township at closing, in a full single lump sum payment, as stated in the bid notice.
The township will warrant, at closing, that each of those lease agreements is valid, enforceable, not in default, and neither party has provided any form of notice of termination, according to the bid notice.
The township council will award the bid at a public meeting within sixty 60 days after the opening date, according to the bid notice.
Bidders are required to comply with the requirements of N. J. S. A. 10:5-31 et seq. and N. J. A. C. 17:27, according to the bid notice.
A contractor, subcontractor or supplier who fails to provide proof of business registration or provides false business registration information shall be liable to a penalty of 25 for each day of violation, not to exceed 50, 000 for each business registration not properly provided or maintained under a contract with a contracting agency, according to the bid notice.
The minimum bid price is $5,850,****, according to the bid notice.
