Delivery shall be made within fifteen 15 consecutive calendar days subsequent to the contract administrator request. In cases of emergency delivery must be made within five 5 consecutive calendar days.

Payments will be made to the contractor within thirty 30 days following acceptance of goods or services, or receipt of a properly prepared invoice by the city department identified in the invoice instructions set forth on the purchase order, whichever is later.

The complete unit will be guaranteed against defects in material and workmanship for a term not less than twelve 12 months, or the manufacturers standard warranty, whichever is longer.

The city may accept the lowest responsible and responsive bid based on the tabulation of any one, combination or all of the base bids, alternate bids, and/or optional bids based on the most advantageous project bid that is desired by the city department involved and that the city council in their sole judgment determines is in the city's best interest and benefit.

Failure to furnish required documentation with the bid may result in the bid being deemed incomplete and non responsive, resulting in rejection.

In the event the city becomes aware an employer with a wage theft adjudication record has submitted a bid or proposal for city work prior to the award of a contract, the city shall deem the employer nonresponsible and refuse to enter into a city agreement with such employer for a period of five 5 years after the date of final adjudication.

The city of El Paso reserves the right to request samples from bidders prior to award of contract.

Any person or entity that violates the Cone of Silence/Anti-Lobbying Policy may be disqualified.

Deliveries are phased over approximately 300 days, with specific deadlines for Phase 1 (7 days after award), Phase 2 (**** days after award), Phase 3 (**** days after award), and Phase 4 (**** days after award).

All invoice submissions must be made electronically through the U. S. Department of Treasury's Invoice Processing Platform (IPP). Payment will be made based on government acceptance of deliverables and certification of accurate labor charges.

A full 1-year manufacturer warranty is included, and the entire system shall be warranted for parts and labor for twelve months from the date of installation and acceptance. Warranty coverage commences upon government acceptance.

Award will be made to the lowest-priced offeror whose offer is determined technically acceptable. Technical acceptability will be determined on a pass/fail basis against the salient characteristics and minimum requirements.

Offerors must be the manufacturer or an authorized reseller of the items quoted. They must also provide a technical description of the items or services offered in sufficient detail to evaluate compliance with the requirements.

If the contractor fails to deliver all requested supplies within its designated delivery phase, the contractor shall pay, as fixed and agreed liquidated damages, a reasonable sum identified by the government for each calendar day of delay until delivery is complete.

Quotes that do not meet all salient characteristics will be determined technically unacceptable and will not be considered for award. Submissions with macros or executable file types may be considered nonresponsive.
