Under any resultant solicitation, offerors may be required to provide samples of proposed strategic commercial clothing and or letters of commitment from the manufacturers of the strategic commercial clothing with either a government test report showing that the cloth meets the requirements or a full test report from a certified laboratory to demonstrate this. The contractor shall deliver all items within the timeframe stated in the bid documents. For specific delivery locations, items will be delivered to the Henderson Fire Department at 332 Washington Street, Henderson, KY ****, and after construction completion, to Henderson Fire Station No. 1 at 540 2nd Street, Henderson, KY ****.

Payment shall be made upon receipt of a properly submitted invoice and satisfactory delivery of uniforms and related items, as determined by the city.

The contractor shall replace any item determined by the city to be defective in material, workmanship, sizing, or appearance at no additional cost to the city. Equipment shall be fully functional and free from defects upon installation.

The contract shall be awarded to the responsive and responsible bidder whose proposal receives the highest overall evaluation score and is determined to be in the best interest of the city. Bids will be evaluated on the basis of lowest bid price or lowest evaluated bid price.

Responsible bidder means a person who has the capability in all respects to perform fully the contract requirements, and the integrity and reliability which will assure good faith performance.

If the successful bidder fails to perform the services in accordance with the bid documents, the city may require corrective action, withhold payment for unsatisfactory performance, terminate the contract, or procure services from another source and hold the contractor responsible for any additional costs.

Failure to comply with the instructions to bidders and all other applicable sections of the bid package may result in the bid being deemed nonresponsive. Unsigned bids may be rejected as nonresponsive. Failure to submit any required enclosed document may result in rejection of the bid.

The first delivery order is due to begin 90 days after award, with 30-day increments and 90 days lead time for subsequent delivery orders with 30-day increments.

Best value trade off source selection procedures will be utilized. Technical and past performance, when combined, are more important than cost or price.

Only small business firms may submit offers for this acquisition. Offerors will be required to submit a total of two size large product demonstration models for the socks, liner, black from each proposed place of performance.
