No proposal will be accepted from or contract awarded to any person, firm or corporation that is in arrears or is in default to the city upon any debt or contract, or that is a defaulter, as surety or otherwise, upon any obligation to said city, or had failed to perform faithfully any previous contract with the city of Greenfield.
The acceptance of a bid will bind the successful bidder to execute the contract and to be responsible for liquidated damages as hereinbefore provided.
Samples of the delivered product may be taken by city during delivery. Should the results of testing on these samples indicate that the chemical does not comply with the above specifications the material will not be accepted by the city.
To receive consideration, such questions [regarding interpretation of contract documents] shall be submitted in writing at least five working days prior to the date of receipt of proposals.
Failure or neglect to execute a contract within the said period of fifteen (15) days shall constitute a breach of the agreement affected by the acceptance of the bid. The city shall then go to the next lowest bidder to execute a contract.
