The Town of Granite Falls will make progress payments on account of the contract price on the basis of contractors applications for payment as recommended by engineer, on or about the 25th day of each month during construction. Progress payments will be made in an amount equal to 95 percent of work completed, with the balance being retainage. Final payment will be made upon final completion and acceptance of the work.
Contractor warrants and guarantees to owner that all work will be in accordance with the contract documents and will not be defective. This warranty excludes defects or damage caused by abuse, modification, or improper maintenance or operation by persons other than contractor, subcontractors, suppliers, or anyone for whom contractor is responsible, or normal wear and tear under normal usage. The warranty period is one year after the date of substantial completion, or longer if prescribed by special guarantees or contract documents.

Contractor shall pay owner five hundred dollars ($500) for each day that expires after the time specified for substantial completion until the work is substantially complete. Contractor may submit a change proposal regarding its entitlement to or the amount or extent of any adjustment in the contract price or contract times, or both, no later than 30 days after owners issuance of the owners written statement to contractor regarding the subsurface or physical condition in question.
