Final payment on the agreement shall be made in 45 days after successful completion of the services.

The contractor warrants that all work performed under this agreement conforms to the agreement requirements and is free of any defect in equipment, material, or design furnished, or workmanship performed by the contractor or any subcontractor or supplier at any tier. This warranty shall continue for a period of 1 year from the date of issuance by the city of written final completion of the services.

The owner will award to lowest responsible bidder taking into consideration quality, performance, and time specified in bid form for performance of work.

To demonstrate qualifications to perform the work, bidder will be required to submit written evidence on financial data, previous experience, present commitments, and other such data as may be requested by owner or engineer.

Liquidated damages of **** per calendar day are hereby agreed upon as assessment from the contractor for failure to complete the work within the time stated herein.

If the successful bidder fails to execute said agreement and to furnish this and any other required documents pertaining to the work within ten 10 days from the date of delivery of this notice of award, said owner will be entitled to consider all your rights arising out of the owners acceptance of your bid as abandoned and to award the work covered by your proposal to another, or to rebid the work or otherwise dispose thereof as the owner may seefit.

Each proposal must be accompanied by a deposit equal to 5 of the net price bid.

The bid notice states that sealed bids are due by 11:00 a. m. on Wednesday, April 01, 2026, and will not be accepted after that time.

The bid notice states that failure to attend the mandatory pre-bid meeting will disqualify your bid.

A mandatory pre-bid meeting is scheduled for Thursday, March 05, 2026, at 10:00 am at the Teen Center Plaza Skatepark, 405 E Grand Ave, El Segundo, CA ****.

All questions regarding the project are due by Monday, March 16, 2026 at 5:00pm.

The deadline for submission of bids is 3:00 PM on April 23, 2026.

The owner shall make partial payment on a monthly basis to the contractor in accordance with the contract documents on the basis of a duly certified and approved estimate of work performed during the preceding calendar month by the contractor, less five percent (5%) of the amount of such estimate which may be retained by the owner until all work has been performed strictly in accordance with the contract documents and until such work has been accepted by the owner.

The contractor warrants to the owner that all materials and equipment furnished under this contract will be new unless otherwise specified, and that all workmanship will be of first class quality, free from faults and defects and in conformance with the contract documents and all other warranties and guaranties specified therein.

The award of the contract will be to the responsible bidder submitting the lowest responsive base bid.

Each bidder must be prepared to submit within five calendar days of the owners request written evidence of his qualifications for the project, including, without limitation, financial data, previous experience, resources, personnel and evidence of authority to conduct business in the jurisdiction where the project is located.

The timeframe for fabrication and installation will be 90 days from award of contract by the City of Lynchburg, with a 100-day penalty if not completed in the timeframe allowed.

Bidders are requested and expected to visit the site of the project to alert themselves to local and special conditions which may be encountered during construction of the project.

Any protest to award a contract shall be in writing and shall be delivered so that it is received by the City Manager not later than five (5) business days after announcement of the award or decision to award, whichever comes first.
