The City of Atwater is seeking proposals from qualified firms for the engineering design of the Green Sands Avenue Utilities Extension/Canal Creek Crossing project. The proposal must not exceed 40 total pages most or all 8 x 11 inches with 1inch or greater margins, excluding the transmittal letter, index or table of contents, front and back covers, title pagesseparationtabs, and appendices. A maximum of ten of the total pages may be 11 x 17inch trifold format. Elevenpoint font or larger must be used in proposal parts 1 6. The city expects all proposers are willing and able to sign the agreement as presented. If a proposer believes specific items in the agreement are out of date, not applicable, or place an undue burden or cost on the proposer or city, the proposer must present these concerns in writing in proposal appendix d design services agreement markup. The owner is not obligated to accept any of the requested exceptions, modifications, additions, etc. submitted by the respondent, if any, in the design services agreement markup when negotiating and finalizing the design services agreement. Furthermore, the owner may request additional revisions during negotiations and before finalizing the design services agreement. Respondents are encouraged to carefully review rfp attachment c sample design services agreement and to submit written questions and comments by the deadline specified in section 4. Based on its assessment of the comments submitted, the owner at its sole discretion may modify the sample design services agreement via addenda. The owner expects that this review and comment process will substantially reduce the need for extensive postselection negotiation. Any exception to the agreement made as part of a proposal can be grounds for disqualification of the proposal. The city will review the submittals and will rank the proposers. The evaluation of the proposals shall be within the sole judgment and discretion of the committee. All contacts during the evaluation phase shall be through the city of atwater contract administratorproject manager only. Proposers shall neither contact nor lobby evaluators during the evaluation process. Attempts by proposer to contact members of the committee may jeopardize the integrity of the evaluation and selection process and risk possible disqualification of proposer. The selection process may include oral interviews at the sole discretion of the committee. If required, proposers will be notified of the time and place of oral interviews and of any additional information that may be required to be submitted. After the evaluation process is complete, the owner will notify respondents of the rankings. The topranked respondent will be either selected for contract award on the basis of its design services agreement markup or offered the opportunity to negotiate the final terms of the design services agreement.
