The electronic bid submittal deadline is Tuesday, June 30, 2026, at 1:00 PM CST. No proposal will be accepted after this date and time unless in the best interest of NOLAPS by an addendum notification.

Invoices will be paid based upon receipt of material or properly executed invoice, whichever is later. Payment will be made on the basis of unit price as listed in the blanket order. In no case will the OPSB refuse to make partial payments to the bidder although all items have not been delivered.

Awards will be made to the responsible vendors whose proposals are determined after evaluation by NOLAPS to be the best value to NOLAPS. The bid will be awarded to the lowest responsible and responsive bidder that meets or exceeds the specifications/scope of work.

To qualify for evaluation, a proposal must have been submitted sealed and on time and must materially satisfy all mandatory requirements identified in this document. Specifications and qualification documents may be obtained by visiting the districts website at www. ***. *. *

If the bidder fails to meet the requirements or to deliver articles within the time specified elsewhere in these specifications, the board reserves the right, without prior notice or putting in default but by mere lapse of time, to obtain the articles from any other person or firm at such price as may be charged without competitive bids. The difference between the price paid and the contract price shall be deducted from the following or any subsequent payment to the contractor.

When called for, samples shall be submitted with the bid per instructions set forth in the special terms and conditions if applicable. Additional samples needed for a bid to be evaluated properly shall be delivered within 5 business days from the time the proposer is notified by the purchasing department. Sample items from the successful proposer may be retained for the purpose of determining that the quality and workmanship of the delivered items are comparable to the sample.

If any proposer who submitted a proposal has an objection to the award of the contract to the selected proposer, the objecting proposer shall furnish that protest, in writing, to the executive director of procurement or designee within ten 10 business days of the notification of nonaward.

Proposers who violate the code of silence may be deemed nonresponsive, and their proposal may be rejected for cause. Failure to follow instructions regarding proposal forms may result in disqualification. Failure to comply with debarment and suspension requirements will cause your bid to be disqualified and declared nonresponsive. Violation of the provision regarding contact with district employees (except through the executive director of procurement) shall be considered grounds for disqualification.

The required delivery date for all items is July 1, 2026.

Failure to provide a spec sheet and item in vendor remarks when bidding an alternate MPN may result in bid rejection.

The response due date is June 25, 2026, at 1:30 PM Central Time.

Payment terms for the State of Texas are typically 30 days. Respondents may provide their additional discount extended to each invoice on attachment B.

The warranty period will begin on the date of the customer's acceptance of each product. Contractor warrants against defects in workmanship and material for a period of 90 days or the duration of the manufacturer's standard warranty, whichever is longer.

CPA will determine best value for the state. CPA will consider compliance with specifications, purchase price, and risk of vendor nonperformance. Delivery ARO may be reviewed as a best value factor.

CPA may disqualify a respondent if there is an unacceptable risk that it will fail to perform the contract. The respondent bears the burden of establishing ability, capacity, skill, promptness, character, responsibility, integrity, current compliance with laws, sufficient financial resources, and conformity to material specifications.

If nonpayment of the Texas Smartbuy administrative fee reaches 90 days, the contractor may be placed on warrant hold. CPA and the customer may exercise contractual remedies in connection with late delivery.

CPA may request samples prior to award for evaluation purposes. If requested, respondent must submit samples within sixty calendar days of receipt of the request. Failure to submit samples is cause for disqualification.

Communicating with anyone other than the point of contact listed may result in disqualification. CPA will disqualify any response received without the required documentation. Failure to submit signed addenda, certified lab test reports, or samples (if requested) may cause disqualification.

Vendor will provide equipment within 14 days upon contract award.

The contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract.

Proposals will be evaluated on technical capability and price.

Quoters are required to be registered in SAM at the time a quotation is submitted.

When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers.

Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
