When a product is found to be out of specification, the entire shipment may be rejected at the MOAMO option. In the event that a delivered product is entirely or partially used before it is determined to be out of specification, the vendor will be responsible for the removal of the material or immediately provide replacement emulsion that conforms to specification at no additional cost to the MOAMO.

After opening of the invitation to bid, the apparent low bidder shall submit an emulsion sample to an independent laboratory for conformation testing at the vendors expense. Upon the completion of testing, the MOAMO shall be provided a copy of the test results within 24 hours of receipt by the vendor.

Failure to acknowledge addenda may result in bid being considered non responsive. Faxed or emailed bids will not be accepted. Bids not in compliance with the above requirements may be declared nonresponsive and held unopened by the purchasing department.

Proposals are due by Monday, June 30, 2026, at 1:00 PM local time. The contract period is from August 1, 2026, through July 31, 2027.

Agencies will process invoices within thirty (30) days of receipt of a correct invoice. The state intends to maximize the use of the P-Card for payments.

Awards will be based on pricing (40 points), compliance with NSLP specifications (20 points), product quality and uniformity (20 points), and capacity to deliver to multiple sites (20 points).

Vendors must be qualified fresh pizza vendors and must provide a company profile, description of services, food safety plan (HACCP), business references, business license, and proof of insurance.

In the event the vendor does not fulfill its obligations, the ordering agency may terminate orders and purchase equivalent products on the open market. Any difference in cost will be the responsibility of the vendor.

A mandatory pre-bid meeting has not been established for this request for proposal.

Samples are required for evaluation purposes. They shall be such as to permit the agency to compare and determine if the item offered complies with the intent of the specifications.

Protests based on any omission or error, or on the content of the solicitation, will be disallowed if these faults have not been brought to the attention of the designated contact, in writing, no later than ten (10) calendar days prior to the time set for opening of the proposals.

Causes for disqualification include more than one proposal from the same entity, evidence of collusion, unsatisfactory performance record, suspension or debarment, unbalanced unit prices, unauthorized additions or irregularities, and non-attendance of mandatory pre-bid meetings.

All deliveries shall be made within 48 hours of receipt of order.
