The prime contractor agrees to pay each subcontractor under this prime contract for satisfactory performance of their contract no later than 30 days from the receipt of each payment the prime contractor receives from the recipient. The prime contractor agrees further to return retainage payments to each subcontractor within 30 days after the subcontractors work is satisfactorily completed.
In accordance with title 29, subsection **** of the Delaware code, a penalty of $2,**** will be withheld from the successful bidder for each occurrence for the failure to utilize any or all of the subcontractors set forth below.
Protests based upon restrictive specifications or alleged improprieties in the bidding procedure shall be filed in writing with DTC's Finance Administration Manager at least ten (10) calendar days prior to the bid opening. Protests based upon the award of a contract shall be submitted in writing to DTC's Finance Administration Manager no later than ten (10) calendar days following the award of the contract.
Failure by the contractor to carry out DBE requirements is a material breach of this contract, which may result in the termination of this contract or such other remedy as the recipient deems appropriate, which may include, but is not limited to: withholding monthly progress payments, assessing sanctions, liquidated damages and/or disqualifying the contractor from future bidding as nonresponsible.
