The intent is to take possession of the equipment no later than 180 days of bid award. The successful bidder will be required to arrange delivery to 400 W stephen st. , suite 301, martinsburg, wv, ****.

A 3-year NBD onsite warranty is required for the laptop computers.

The contract will be awarded to the company whose proposal, conforming to this request, will be the most advantageous to Berkeley County, considering responsiveness, past performance, specialized experience, technical competence, oral presentations, staff qualifications, firm capacity, familiarity with services, references, and price proposal.

Proposals must include proposer information, capabilities, firm principals and background, and written proof that the selected company is licensed to conduct business in West Virginia and employs only US citizens or legal immigrants.

Failure to provide required information may result in disqualification. If the awarded firm fails to comply with specifications, they will be given 30 days notice to render satisfactory service; failure to correct unsatisfactory conditions may result in contract termination.

Failure to provide the required information as requested in the RFP for Berkeley County's review may result in disqualification. Failure to discuss each item in the technical proposal may deem the submittal nonresponsive and may result in non-consideration of respondents services.

Delivery must be made as ordered and in accordance with the terms of the contract. Unless otherwise specified in the bid specifications, delivery shall be made within thirty calendar days after receipt of a purchase order by the contractor.

While prompt payment discounts will not be considered in determining the low bid, the commissioner may consider any prompt payment discount in resolving bids which are otherwise tied.

The contractor shall be solely responsible for assuring that deliveries are made to personnel authorized to accept or receive product on behalf of the authorized user.

The commissioner reserves the right to accept or reject any and all bids, or separable portions of offers, and waive technicalities, irregularities, and omissions if the commissioner determines the best interests of the county will be served.

The contractor must be prepared, if requested by the commissioner, to present evidence of experience, ability and financial standing, as well as a statement as to plant, machinery and capacity of the manufacturer for the production, distribution and servicing of the product bid.

The contractor shall comply with all provisions of all laws in the county of rockland, the state of new york and the united states of america that affect municipalities and municipal contracts.

The commissioner reserves the right to request from the bidder/contractor representative samples of the product offered at any time prior to or after award of a contract.
