The successful contractor's failure to meet the services schedule, or any other deficiencies that should arise, and given a reasonable length of time to correct said deficiencies, will be cause for termination of the order/contract by issuance of a written notification of cancellation. The delivery date specified in this solicitation is only an estimate. Actual delivery date will be determined at time of award based on vendors quoted lead time.

The award will be based on best value to the government, considering price and delivery, to the responsible offeror otherwise conforming to all solicitation requirements.

Submissions not received by the date and time specified in the solicitation or not providing all of the required documentation, may not be considered for award.

Each call awarded under this agreement will have a delivery date for that specific call.

The government will make all payments within 30 days of receipt of proper invoicing after delivery of supplies in accordance with each specific BPA call.

BPAs will be established based on the overall best value quotations determined to be the most beneficial to the government, considering technical capability, past performance, and price.

Offerors are required to have an active System for Award Management (SAM) registration with no active exclusions. They must also comply with licensing and qualifications requirements of the state where work is performed.

Failure to provide a geographic capability statement addressing all nine locations will result in the proposal being determined technically unacceptable and excluded from further evaluation and award.

The total capacity for the BPA pool is not to exceed $12,000,****.
