The bidder agrees to complete the work within 80 working days from the date the notice of intent to award is issued, as modified by additional days added by the owner's acceptance of alternates, if applicable. This includes ten 10 working days for document mailing and processing.

The bidder must have examined and be familiar with the local conditions affecting the work and with the complete set of contract documents, including drawings, invitation for bid, instructions to bidders, statement of bidders qualifications, general conditions, supplement to general conditions, and technical specifications. Additionally, bidders must comply with Missouri prevailing wage law and potentially the Davis-Bacon Act if federal funds are involved. Bidders must also be enrolled and participating in a federal work authorization program and warrant that they do not knowingly employ unauthorized aliens.

The bidder further agrees to pay to, or allow the state as liquidated damages the sum of $700 for each working day thereafter that the entire work is not substantially complete. The contractor shall forfeit a penalty to the owner of one hundred dollars per day or portion of a day for each worker that is paid less than the specified rates for any work done under the contract by the contractor or by any subcontractor, in accordance with section ****, RSMo.

Delivery of chemicals is expected to be available for use at the plants no later than July 1, 2026.

The city will select the bid that, in its sole discretion, is the most responsive and responsible bid to the city. Determination of best response to bid will be the sole judgment of the City of Gainesville.

When determining whether a bidder is responsible, or when evaluating a bid, the following factors may be considered: the ability, capacity and skill of the bidders to perform the contract or provide the equipment and/or service required; the character, integrity, reputation, judgment, experience and efficiency of the bidders; whether the bidders can perform the contract within the time specified; the quality of performance of previous public and private contracts or services; the city’s termination for default of a previous contract with a bidder, within the past three years; the previous and existing compliance by the bidders with laws relating to the contract or service; evidence of collusion with any other bidders; the bidders has been convicted of a crime of moral turpitude or any felony, excepting convictions that have been pardoned, expunged or annulled; if the bidders will be unable, financially or otherwise, to perform the work; at the time of the bid opening, the bidder is not authorized to do business in Georgia, or otherwise lacks a necessary license, registration or permit; any other reason deemed proper by the city.

The bidder shall provide a 25lb. sample lot free of charge for liquid totes evaluation before order will be placed for potable water grade coagulation aid polymer dry. Selected vendor will be required to provide a sample to the riverside plant for sodium silicofluoride.

All questions must be submitted in writing to the bid correspondent named above. Questions must be received by 10:00 a. m. , 05/06/26.

The contract duration is to be determined by the contractor, to be input by the bidder, and the project will be completed within the stipulated calendar days from receipt of the notice to proceed. The notice to proceed is expected within 10 days of contract execution, or a mutually agreed upon period.

The bid notice does not explicitly state the payment terms, but it mentions that payment shall be based on the unit price for the actual amount of work completed and/or material furnished.

The bid notice mentions a maintenance bond will be required, but does not specify the duration or terms of the warranty for the work performed.

The bid notice states that the owner will accept that bid deemed most advantageous for value received, and the low bidders will be selected by the lowest and best bid, considering all bids, which include selected alternate bids.

The city may choose to make investigations to determine the ability of the bidder to perform the work, and the bidder shall furnish all such information and data as the city may request. The city reserves the right to reject any bid if the evidence submitted by, or investigation of, such bidder fails to satisfy the city that such bidder is properly qualified.

The contract includes a provision for liquidated damages in the amount of five hundred dollars (****) per day if all work required under the base bid is not completed in 90 calendar days.

A mandatory pre-bid meeting will be held at the Public Works Facility, 317 Veterans Blvd. , Ardmore, OK, at 10:00 AM on April 22, 2026. Bidders are also responsible for inspecting the site.

The bid notice does not specify a deadline for challenging the bid results.
