Bids are invited for milk, dairy products, and juices for the Wayne-Finger Lakes BOCES and component school districts. Bids will be opened on August 6, 2026, at 3:00 PM. The contract term is from September 1, 2026, to August 31, 2027, with potential for two 12-month extensions. Vendors must be capable of meeting contract terms, including delivery and billing capabilities. Pricing for milk and dairy products will be subject to monthly adjustments based on USDA AMS pricing factors. Juice pricing will be adjusted based on the Consumer Price Index (CPIU). Vendors must disclose any manufacturer rebates, incentives, or credits. Awards will be based on the lowest overall cost to participants, considering pricing, administrative costs, and service-related factors. Tie bids will be resolved by random selection. All products must meet applicable local, state, and federal regulations, including the Buy American provision.

Payments of any claim or invoice shall not preclude BOCES or participants from making claims for adjustments on any item found not to have been in accordance with the contract specifications.
The contractor guarantees that all products delivered under this contract shall be fresh, wholesome, fit for their intended purpose, and ready for use upon delivery. Any product determined to be damaged, spoiled, contaminated, improperly labeled, out-of-code, defective, or otherwise unsuitable may be rejected.
The bid will be awarded based on the lowest overall cost to the participants from responsive and responsible bidders, taking into consideration pricing, administrative costs, and service-related factors.
Bidders must demonstrate experience, financial stability, personnel, stock, plan capacity, and systems requirements to perform the contract, including stocking, warehousing, order taking, delivery, and billing capabilities.
In the event of significant or repeated delivery delays, participants reserve the right to procure the required items from alternate sources. Any documented additional cost incurred as a result of the vendor's failure to perform may be charged back to the vendor.
When a vendor proposes a substitute for a specified product, the vendor shall provide product specifications and, if requested by the BOCES, a sample of the item for evaluation.
Questions about or clarifications to the technical specifications must be made in writing to the purchasing director prior to the bid opening. Such questions must be in the possession of the purchasing director five business days prior to the bid opening.
Bids which are incomplete, unbalanced, conditional, obscure, or which contain additions not called for, alterations or irregularities of any kind, may be rejected as nonresponsive.
