The contractors prices will be evaluated to include any discounts. Past performance will be evaluated for the responsive, technically acceptable quote, and will be evaluated on an acceptable/unacceptable basis. The contractors past performance assessment reporting system cpars, system for award management sam, and supplier performance risk system sprs will be utilized in making an acceptable/unacceptable rating. Contractors with no past performance will not be considered acceptable nor unacceptable and will receive a neutral rating.
The contract delivery period is 52 weeks from May 3, 2026, to May 2, 2027, for item ****.

The contractor warrants and implies that the items delivered under this contract are merchantable and fit for use for the particular purpose described in this contract.

The contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the contractor and without its fault or negligence.
