Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, verified by an authorization letter or other documents from the OEM, such that the OEM’s warranty and service are provided and maintained by the OEM.

Respondents shall include a tailored capability statement indicating the firm’s ability to provide a product and related services, and their DUNS number, organization name, address, point of contact, and size and type of business.

The VA reserves the right to enforce any of its contractual remedies, including termination of contract or, solely at the VA’s discretion, allowing the vendor to replace, at no cost to the government, any remanufactured or gray market item(s) delivered to the VA medical facility upon discovery of such items.

The delivery of gray market items to the VA in the fulfillment of an order award constitutes a breach of contract.

The period of performance for the work will be from September 1, 2026, to December 23, 2026.

The government will award a contract to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the government, price and other factors considered. The evaluation factors will be lowest price technically acceptable.

The contractor shall be accredited through the American Industrial Hygiene Association (AIHA) for fiber counting asbestos analysis by phase contrast microscopy. For TEM analysis, the laboratory selected must be accredited by the National Institute of Standards and Technology (NIST) under the National Voluntary Laboratory Accreditation Program (NVLAP) for asbestos fiber analysis and by the American Industrial Hygiene Association (AIHA).

The contractor will receive samples from a representative of NNSY just outside of the facility in an agreed upon area. For PCM analysis, personal samples shall be analyzed within 5 days of receipt, and perimeter and general area air samples shall be analyzed within 24 hours of receipt. TEM analysis samples are considered more urgent.

Incomplete forms will keep the contract offer from being considered.

Product to be received consistently no more than 21 days after order submitted.

Payment for goods and services received by the district shall be processed in accordance with the Anderson School District Five Procurement Code. A purchase order will be issued and must be referenced on all invoices presented for payment. Invoices should be sent to Anderson School District Five at PO Box 439, Anderson, SC ****.

The vendor shall supply a guarantee for all workmanship for the equipment heshe is furnishing for a period comparable to the standards in the industry. When defects or faulty materials are discovered during the guarantee period, the vendor shall, immediately, upon notification by the district, process at hisher own expense, to repair or replace the same.

Award may not be based solely on price. Final award will be made to the offeror who is found to be responsive and responsible and provides the best solution to meet the needs of the district.

Responses shall be considered only from proposers who are regularly established in the business called for and who in the judgment of the district are financially responsible and able to show evidence of their reliability, ability, experience, equipment supervised by them to render prompt and satisfactory service in the volume called for under this contract.

Should the contractor fail to complete the contract within the established time limit, or at the later date as authorized in writing by the director of procurement, heshe shall pay liquidated damages in the sum of one hundred dollars (****) per day minimum and/or in accordance with the district procurement code.

Responders may be requested to submit samples of all manufactured articles required. Requested samples must be provided at the vendors expense.

Any vendor desiring to exercise rights under section XIV. If a recipient does not submit a response or fails to respond by submitting a no proposal for three (3) consecutive proposals for the same commodity, they may be removed from the applicable vendor list.

Responses to the sources sought notice should demonstrate the firms ability, capability, and responsibility in providing the items listed above.
