A four-year maintenance bond is required for awarded contractors on bids over $100,000.

Any communication in reference to this invitation to bid between bidders and any city employee or official, outside of the purchasing division, during the entire competitive bidding process is strictly prohibited and will result in disqualification.

The contractor shall begin performance within 10 calendar days and complete it within 365 calendar days after receiving award, notice to proceed. This performance period is mandatory negotiable. Work will be planned and phased to be performed between the months of May 1 through October 31.

Payment will be made by the contracting officer. Invoices shall require contracting officer approval for payment. Payments under fixed-price construction contracts are detailed in FAR ****.

The contractor warrants and implies that the items delivered under this contract are merchantable and fit for use for the particular purpose described in this contract. See FAR **** Warranty of Construction.

This acquisition is a 100% small business set-aside. The NAICS code is **** with a small business size standard of $45. 0 million. Offerors must provide a detailed, site-specific safety plan.

If the contractor falls behind the approved schedule, the contractor shall take steps necessary to recover lost time and execute in accordance with the approved schedule, without additional cost to the government. If the contractor does not recover the lost time, the contracting officer may terminate the contractors right to proceed with the work.
