Deliveries and/or pickups shall be made within five (5) business days after receipt of a release notice. Unless specifically directed otherwise, all services shall be delivered and/or picked up Monday through Friday between the hours of 8:00 a. m. and 2:00 p. m. Payment for goods and/or services shall be made in due course of payments of LBPU D after completion of delivery and acceptance by LBPU D and upon receipt of an invoice from the contractor. Payment will usually be made no more than thirty (30) days after receipt of the invoice. Contractor warrants that all services performed under this contract shall be in good working order and shall conform to the contractor's published specifications. Contractor shall guarantee all parts, materials, and labor against failure due to defective material and/or faulty workmanship for a minimum of one (1) year from the date of acceptance. Contractor shall warrant/guarantee all parts, materials and labor done against failure due to defective material and/or faulty workmanship from date of acceptance of the work by LBPU D for a minimum of one 1 year.

The award will be based on the unit prices, percentage discounts given, and in accordance with the provisions of the specification requirements stated herein. Each bidder shall be fully qualified by ability, knowledge, and experience to satisfactorily perform the goods and/or services required. The contractor must have been in business providing welding, machining, and fabrication services for at least the last three (3) years. Failure to respond to emergency service or failure to provide competent responsive service may be cause for termination of the contract or LBPU D may exercise the right to call another company to respond. The expense of this service call shall then be charged to and paid by the contractor. Bidders that do not include required general attachments may be deemed non-responsive and their bids may be rejected. Late bids will not be accepted. Bidders that do not include these items may be deemed as non responsive and their bids may be rejected.

Deliveries shall be made within 48 hours of receipt of an order unless otherwise determined by the facility. Deliveries shall be made between the hours of 8:00 am and 2:00 pm Monday through Friday, excluding state holidays.

Payments, including late payment charges, will be paid in accordance with the State Prompt Payment Act and rules when applicable. Payment terms contained in vendor invoices shall have no force or effect.

The vendor warrants that all products, equipment, supplies, and services purchased under this contract shall be covered by the industry standard or better warranty and unless otherwise specified, full coverage warranty for at least 12 months shall be provided, starting from the time of delivery. The warranty shall be the standard maximum coverage warranty offered that includes materials and labor with no additional charges.

The award will be made to the responsive and responsible vendor who submits the lowest price.

Vendors must be responsible and submit responsive bids. Vendor shall be licensed and certified. Vendor or vendors employees must pass a security background check prior to being allowed on the premises.

Failure to maintain books and records required by this section shall establish a presumption in favor of the state for the recovery of any funds paid by the state under this contract or any subcontract for which adequate books and records are not available to support the purported disbursement.
