The liability for defects in materials or workmanship for a period of one year after the acceptance of the work shall not exceed ten percent (10%) of the amount set forth as the penal sum of the bond.

The board of Mason County Commissioners reserves the right to accept or reject bids on each item separately or as a whole, to reject any or all bids, to waive informalities and to contract as to the best interest of Mason County.

Before award of a public works contract, a bidder must meet at least the minimum qualifications of RCw ****(1)(b) to be considered a responsible bidder and qualified to be awarded a public works project.

Should the successful bidder fail to enter into such contract and furnish satisfactory performance bond within the time stated in the specifications, the bid proposal deposit shall be forfeited to Mason County.

Prospective bidders desiring an explanation or interpretation of the bid documents, shall request the explanation or interpretation in writing by close of business 3 business days preceding the bid opening to allow a written reply to reach all prospective bidders before the submission of their bids.

The estimated value for this project is between $1,000,000 and $1,250,000.
