Sealed bids will be received by the City of Nacogdoches Engineering Office for the 2026 Curb and Valley Gutter Project until 2:00 PM on April 21, 2026. Bids will be publicly opened and read aloud at City Hall Conference Room 203. No fax or email bids will be accepted. Bidders may not withdraw their bid proposal within 60 calendar days of the bid opening date. A certified cashier's check or an acceptable bid bond in an amount of not less than five (5) percent of the total amount bid shall accompany each bid proposal. The City reserves the right to reject any and all bids and to waive any informalities or irregularities. The determination of the lowest responsible bidder may involve factors such as price, conformity to specifications, financial ability, previous performance, qualifications, experience, delivery promise, and payment terms. Bidders may be disqualified for various reasons including failure to use the proposal form, lack of signature, incomplete proposal, evidence of collusion, omission of bid security, unauthorized alteration of bid form, lack of qualifications, unsatisfactory performance, failure to complete projects, or loaded/unbalanced bids. The contract time for substantial completion is 90 calendar days from the notice to proceed. Contractors must comply with all federal, state, and local laws relative to conducting business in the City of Nacogdoches. The laws of the State of Texas will govern. Minority business enterprises will be afforded full opportunity to submit bids and will not be discriminated against. Bidders must be prepared to submit written evidence of qualifications within five days of the City's request. It is the responsibility of each bidder to examine the contract documents thoroughly, visit the site, and become familiar with local conditions. Questions received less than 48 hours prior to opening of bids will not be answered. Only questions answered by formal written addenda will be binding. Bid security will be retained until the successful bidder has executed the agreement and furnished the required contract security. The City may award the bid to a local bidder whose bid is within 5% of the lowest bid if it offers the best combination of contract price and economic development opportunities for the City. The contractor must provide audited financial statements if requested. Prices in the bid proposal shall be presented in the format requested (unit price, lump sum, etc. ). The City is exempt from state retail tax and federal excise tax. Contracting may require compliance with Texas Government Code **** regarding disclosure of interested parties. The contract requires compliance with wage rates as specified in Exhibit A (Davis Bacon Wage Rates). Insurance requirements are detailed in Exhibit B, including Commercial General Liability, Business Automobile Liability, Umbrella Excess Liability, Workers Compensation, and Builders Risk. Performance and Payment Bonds are required as detailed in Exhibit C. A Final Affidavit of All Bills Paid is required from the contractor.
The work shall be substantially completed within 90 calendar days from the date the notice to proceed is given. Final completion is required within thirty (30) calendar days from the date of substantial completion.
Progress payments will be made based on the contractor's applications for payment, less retainage. Final payment will be made after final completion and acceptance of the work, less any withheld sums and retainage.
Upon issuance of a certificate of final completion, the contractor warrants for a period of one (1) year that all labor and materials provided shall be new and of good quality, free from faults and defects, and in conformance with the agreement and industry standards.
All bids will be awarded to the lowest responsible bidder. The determination of the lowest responsible bidder may involve factors such as price, conformity to specifications, financial ability to perform the contract, previous performance, facilities and equipment, availability of repair parts, qualifications and experience, delivery promise, payment terms, compatibility as required, other costs, and other objectives and accountable factors which are reasonable.
To demonstrate qualifications, each bidder must be prepared to submit, within five days of the City's request, written evidence such as financial data, previous experience, and present commitments. Each bid must contain evidence of the bidder's qualifications to do business in the State of Texas or a covenant to obtain such qualification prior to award.
If the contractor fails to substantially complete or finally complete the work within the time specified, the City may permanently withhold from the contractor's total compensation the sum of **** for each and every calendar day that the contractor shall be in default after the time stipulated for substantial completion and/or final completion, not as a penalty, but as liquidated damages.
A pre-bid meeting will be held at City Hall Conference Room 203, Nacogdoches, Texas at 10:00 AM on Thursday, April 9, 2026. This meeting is not mandatory, but attendance is highly recommended.
Samples of items shall be furnished, if requested by the owner, without charge, and if not destroyed, shall be returned upon request at the bidder's expense.
