The contract can be terminated if the bidder/contractor knowingly or intentionally fails to comply with a requirement of subchapter j, chapter 552, government code. he contract can be terminated if the biddercontractor knowingly or intentionally fails to comply with a requirement of that subchapter.

Capabilities statement shall address the following: Contractors clear understanding of equipment in this requirement. Existing contract vehicles e. g. , GSA schedule under which the responder currently offers these supplies, if any. Whether the responder provides the required supplies to the general public under terms and conditions similar to those offered to the federal government.

Neither unsolicited proposals nor any other kind of offers will be considered in response to this rfi. Responses to this notice are not offers and will not be accepted by the government to form a binding contract.

The project must be completed no longer than thirty (30) calendar days after notice to proceed. Work must be continuous until complete. Work will not be allowed on weekends or on holidays observed by the City of Goldsboro.

Invoices are paid net 30 days. The city will make the final payment in full after written job acceptance is granted and the contractor has submitted a proper invoice and other required documentation.

The contractor expressly warrants and guarantees to the city that all work performed under this contract is constructed in strict accordance with the project specifications and is free from all defects in materials and workmanship for two (2) years from the date indicated on the final inspection memorandum.

The owner intends to award a contract to the lowest responsive, responsible bidder, complying with the conditions of the bidding documents.

For projects exceeding $40,000, consideration will be given only to contractors who submit evidence that they are properly licensed as required by chapter 87 of the North Carolina General Statutes to bid and perform the work described herein as a general contractor. The owner may also investigate the bidder's ability to perform the work.

It is each bidder's responsibility to visit the site of the proposed work and fully acquaint themselves with the existing conditions, facilities involved, difficulties and restrictions related to this project.

Any party which is a prospective bidder, offeror, or contractor that may be aggrieved by the solicitation must submit a written protest within five (5) calendar days prior to the opening of the request for bid, request for proposal.

The city reserves the right to disqualify bidders and to remove a bidder from the bidders list for future city construction and repair contracts for failure to make, on more than one occasion with the same or a different subcontractor and on the same or a different city project, timely payments to subcontractors without a reasonable basis.
