The contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract.

It is the government's belief that only the OEM, Selas Heat Technology Co LLC, or their authorized distributors, can obtain the required technical and engineering data and genuine OEM parts. Authorized distributors must submit a letter from the OEM verifying their status.

The city also reserves unto itself the right to award the contract to a contractor whose proposal is not the lowest proposal, but whose knowledge, expertise, reputation, experiences, and/or previous results on projects, most closely meets the demands and needs of the city.

Proponents must have experience in the specific area outlined by the various sections of this proposal. Proponents shall submit all information related to their ability to successfully perform the work described in the rfp.

The contractor shall deliver all items using Free On Board (FOB) destination no later than 30 May 2026.

Full payment shall not be a condition for delivering the items required in the contract. The items will be paid in full once the government receives, inspects, and accepts all the items requested in the contract.

The items shall include a manufacturer warranty against manufacturing defects and workmanship for a period of at least one year.

If the items delivered are not in compliance with the terms, conditions and specifications of the contract, the COR will immediately notify the CO and items will be rejected. In the event items are rejected, the CO will notify the contractor in writing within 5 business days of the inspection. The contractor shall have 5-10 business days after notification to correct the deficiencies and deliver the items at no cost to the government.
