This is a public tender for the establishment of a term contract for drag chain conveyor style dump bodies. The tender is set aside for MBE-certified bidders only. Bidders must be certified by the Ohio Equal Opportunity Coordinator and include a copy of their MBE certification letter. All bids must be submitted electronically in Ohio Buys by the published deadline. The contract duration is 12 months from the date of award. All deliveries must be FOB destination to any of ODOT's 12 districts and 88 counties in Ohio. Price increases may be requested within 60 calendar days of the bid opening, but no additional price increases may be sought for 30 calendar days after an approved increase. The department reserves the right to reject any proposed price increase or to cancel the contract. Delivery of prototypes must be made within 240 calendar days. The vendor assigns to the state of Ohio all of its rights to any claims and causes of action under department or federal antitrust laws. The vendor may not disclose any information obtained as a result of this contract without the written permission of the department. The vendor agrees to comply with all applicable department and federal laws regarding drug-free workplace. The vendor will maintain workers compensation insurance. The vendor agrees that it is currently in compliance and will continue to adhere to the requirements of Ohio ethics law. Vendors who attempt to influence the evaluation and/or award of a contract will be disqualified. The vendor will not advertise that it is doing business with the department without prior written consent. The failure of either party to demand strict performance by the other party will not be construed as a waiver of any such term. All sections relating to payment, confidentiality, license and ownership, indemnification, publicity, construction warranties, limitations of warranties and limitations on damages shall survive the termination of this contract.
