The agency reserves the right to change any of the scheduled dates, amend IFB requirements, withdraw the IFB, evaluate, accept and/or reject any and all bids, and waive technicalities, irregularities, and omissions. The agency reserves the right to seek clarifications, request proposal revisions, or to request any information deemed necessary for proper evaluation of proposals from all bidders deemed to be eligible for contract award. The contract resulting from this IFB will not be effective until approved by the Office of the State Comptroller. A debriefing is available to any entity that submitted a proposal or bid in response to a solicitation. Bidders must comply with NYS Finance Law 139i, which requires a certification that the bidder has and has implemented a written policy addressing sexual harassment prevention in the workplace and provides annual sexual harassment prevention training to all of its employees. The bidder warrants that it has carefully reviewed the agency's needs and specifications, and that it can provide the services as described in the IFB. If awarded the contract, the bidder agrees that it will perform its obligations in accordance with all applicable federal, state, and local laws, rules, and regulations. The bidder further warrants that the terms of this IFB and any resultant contract do not violate any contracts or agreements to which it is a party. If this or any other contract is valued at $100,000 or more, the vendor must file the required vendor responsibility questionnaire online via the NYS VendRep system. Tax Law 5a applies to contracts where the total amount of sales delivered into New York State are in excess of $300,000 for the four quarterly periods immediately preceding the quarterly period in which the certification is made. The contractor agrees not to use the agency's name, logos, images, or any data or results arising from this procurement process or contract as a part of any commercial advertising without prior written approval. The contractor agrees to indemnify the state of New York, the agency, and their officers, employees, and agents from any claims arising out of the services provided.
