The method of award involves submission review, technical evaluation, cost evaluation, composite score, reference checks, and best and final offers.

Bidders must have at least three years of experience in developing and delivering in-person classroom style training initiatives and developing and delivering online training programs and coordination of training activities.

The department reserves the right to assess a 5% penalty on payment of the deliverable for a given month if mutually agreed upon timelines for curricula development or revision are unmet. This penalty will continue to be enacted until timelines are met. The penalty does not apply to delays caused by the department.

Failure to meet minimum qualifications will result in a proposal being found nonresponsive and eliminated from consideration.

The deadline for receipt of proposals is July 27, 2026, at 1:00 PM EDT.

Payments for services will not be made in advance of work performed. The state may require holdback of contract monies until acceptable performance is demonstrated, up to 25%.

The vendor will provide a warranty that the deliverables will function as designed for a period of no less than one year from the date of system acceptance.

The contract will be awarded to the vendor whose proposal is most advantageous, taking into consideration the evaluation factors set forth in the RFP. The contract will be awarded to the vendor whose proposal is the most advantageous to the state of Delaware.

Vendors must provide Delaware licenses and/or certifications necessary to perform services and proof of state of Delaware business licensure or initiate the process of application.

The state of delaware may include in the final contract liquidated damages provisions for nonperformance.

Protests based on any omission or error, or on the content of the solicitation, will be disallowed if these faults have not been brought to the attention of the designated contact, in writing, at least ten 10 calendar days prior to the time set for opening of the proposals.

Vendors may be disqualified for submitting nonconforming proposals, failing to respond to requests for information, or for certain criminal convictions or contract violations.

Proposals must be received no later than 4:30 PM on Friday, June 12, 2026.

Cash discounts may be offered for prompt payment, but will not be considered in determining the low proposer. The payment date is calculated from the receipt of invoice or final acceptance of goods, whichever is later.

Proposals shall be evaluated based upon: data migration (15%), proposers comprehension of the required scope of services (30%), work prior experience in similar projects (15%), professional qualifications (10%), total proposed price (10%), proposers demonstrated capabilities (10%), and client references (10%).

Proposers must provide a statement of qualifications including firm history, professional staff experience, authorized signatories, experience with case management systems, and at least two references from similar projects.

In the event of a breach by the contractor, the contractor shall pay to the county all direct and consequential damages caused by such breach.

Conditional proposals will not be accepted. Failure to satisfy the county that the proposer is properly qualified may result in rejection. Proposals may be rejected for failure to follow the specified format.
