The contract will expire based on the schedule for delivery of services as outlined in this ifb or by the date or delivery days after receipt of order aro provided by the bidder.

HHSC will make contract payments in accordance with chapter **** of the texas government code, commonly known as the texas prompt payment act.

HHSC shall not be obligated to select the bidder with the lowest price but shall make an award to the bidder who provides the best value to the state of texas.

To be considered for award, bidders must submit a comprehensive response which includes all required information and documentation as outlined in this ifb.

The contractors noncompliance or failure to timely correct the deficiency may result in delayed payment or nonpayment as determined by the hhs agency.

The CHA will award a contract to the responsible bidder whose bid is responsive and conforms to the solicitation, will be most advantageous to the CHA, is the lowest unit price per category, and the price-related factors specified in the solicitation for the base period of three 3 years.

The bidderfinancially responsible party shall demonstrate its financial capacity by submitting the most recent two 2 years of audited, reviewed or compiled financial statements prepared by a third party licensed certified public accountant cpa.

At the chas option, noncompliance will result in 1 all payments due the vendor being withheld until the vendorhas complied with the agreement or 2 the vendor will be assessed five hundred dollars **** for everyday of noncompliance or 3 the vendor will be immediately removed from the premises and the agreementwill be terminated for default.

The cha reserves the right to conduct a preaward meeting with the bidders todetermine if a bidder is a responsible party pursuant to federal law. This meeting may include a review of: ivisit to the bidders facilities and a visit to the facilities.
