The guarantee period shall be in effect for three hundred and sixty five days thereafter. The guarantee period shall begin on the date on which the work of improvement for this public works agreement is accepted by the agency, or the date of recordation of the notice of completion, whichever is earlier, and shall be in effect for three hundred and sixty five days thereafter.

The agency shall award the contract to the responsible bidder who has submitted the lowest responsive total bid amount. if the agency determines that it is in the agency's best interest to award the contract, a notice of award shall be issued and sent to the responsible bidder which has submitted the lowest responsive total bid amount as determined by the agency.
