Delivery must be made as ordered and in accordance with the terms of the contract. Unless otherwise specified, delivery shall be made within thirty calendar days after receipt of a purchase order by the contractor.

Prompt payment discounts will not be considered in determining the low bid, but may be considered in resolving tied bids. Any notation indicating that the price is net, e. g. , net 30 days, shall be understood to mean only that no prompt payment discount is offered.

The contract shall be subject to product warranties. Repaired, replaced or substituted products shall be subject to all terms and conditions for new products set forth in the contract, including product warranties.

Bidders must be prepared, if requested by the commissioner, to present evidence of experience, ability and financial standing, as well as a statement as to plant, machinery and capacity of the manufacturer for the production, distribution and servicing of the product bid.

There may be deducted from the amount payable to the contractor by the state of municipality a penalty of five dollars for each person for each calendar day during which such person was discriminated against or intimidated in violation of the provisions of the contract.

The commissioner reserves the right to request from the bidder/contractor representative samples of the product offered at any time prior to or after award of a contract. Unless otherwise instructed, samples shall be furnished within the time specified in the request.

Bidder may be disqualified from receiving awards if bidder, or anyone in bidder's employment, has previously failed to perform satisfactorily in connection with public bidding or contracts.
