The evaluation will be based on Company Background Experience, System Capabilities/Features, System Security, Privacy, and Compliance, Cost, References, Vendor Service Support, Implementation Timeline and Milestones, and Indian Preference/TERO Certification.

Vendors must demonstrate experience managing FMLA for organizations with at least 4,000 employees and provide proof of TERO certification for Indian preference. The nation may make such investigations as deemed necessary to determine the ability of the responding party to perform the work.

The contract term is twelve 12 months from the date of award, with four 4 optional one-year periods. Specific deliverables have deadlines ranging from 14 to 21 calendar days from the date of award or notice to proceed, with maintenance and support starting upon completion of post-implementation support and training.

Payment will be made upon completion and acceptance of work, with invoices submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform (IPP). Specific payment percentages are outlined for different contract line items (CLINs), with maintenance and support paid quarterly.

The procurement includes necessary software, licenses, and warranties as specified in Section C. The contractor must also provide ongoing high-quality maintenance and end-user support.

The award will be made to the responsible offeror whose offer conforms to the solicitation and will be most advantageous to the courts, considering price, technical approach, experience, qualifications, past performance, and customer service.

Vendors must be qualified to provide a cloud-hosted, configurable commercial-off-the-shelf legal case and document management system. SAM registration is required to receive a contract award.

If services do not conform to contract requirements, the courts may require the contractor to perform services again or take necessary action to ensure future performance. Failure to do so may result in the courts performing the services and charging the contractor, or terminating the contract for default.

Failure to acknowledge solicitation amendments may result in rejection of the offer. Material omissions or failure to follow instructions may also lead to elimination from consideration for award. Conflicts of interest, if not disclosed, can lead to termination for default or debarment.
