The Town of Spencer, Massachusetts is seeking sealed bids for the seasonal requirement of gasoline and diesel fuels for Fiscal Year 2027 (July 1, 2026, through June 30, 2027). Bid documents will be available online on May 21, 2026. Sealed bids must be submitted to the Department of Utilities and Facilities by June 11, 2026, at 10:00 a. m. , at which time they will be publicly opened. Bids must conform to specifications and be submitted on proper forms. A bid deposit of 5% of the bid value is required. Bidders should not include sales or federal excise taxes. Escalation clauses will result in rejection. The Town reserves the right to reject any or all bids. Minority and woman-owned businesses are encouraged to bid. Prevailing wage rates apply. The contractor must provide insurance and comply with all applicable laws. The contract term is from the date of award until June 30, 2027. Pricing will be based on the low posting, reseller tank car pricing, Boston, MA, on the date of delivery, plus a firm increment for operating expenses and profit. Estimated annual quantities are 20,000 gallons of diesel fuel and 25,000 gallons of gasoline, but vendors must supply all ordered product. The bid documents state that sealed bids will be accepted until June 11, 2026, at 10:00 a. m. The contract term will commence on the date of award and terminate on June 30, 2027.
The Town shall make payments within thirty (30) days after its receipt of an invoice.
The vendor must, upon notice by the Department of Utilities Facilities, or its designee, make prompt and without charge, replacement of any unleaded gasoline furnished which fails to conform to specifications.
Contracts will be awarded to the responsive and responsible bidders offering the lowest total price for each category of items bid items A, B, and C.
No award will be made to any bidder who cannot satisfy the owner that they have sufficient ability and experience in this class of work and sufficient capital and plant to enable them to prosecute and complete the work successfully within the time named.
The successful bidder, upon their failure or refusal to execute and deliver the contract and bonds required within 10 days after presentation thereof by the owner, shall forfeit to the owner, as liquidated damages for such failure or refusal, the security deposited with their bid, but the amount forfeited shall not exceed the difference between their bid price and the bid price of the next lowest responsible and eligible bidder.
At the time of the opening of bids, each bidder will be presumed to have inspected the site and to have read and to be thoroughly familiar with the contract documents including all addenda.
Prior problems, issues or concerns of any kind with work performed for the Town of Spencer shall be grounds for disqualification.
