The town of new castle shall make partial payments on account of the contract, if applicable, in accordance with the provisions of the contract documents.
Awards shall be made for each item independently, taking into consideration the availability of materials due to plant location, subject to the lowest responsible bid standard.
The proposer declares and warrants that they are financially solvent and experienced and competent to perform the type of work or furnish the materials, supplies or equipment.
If the contractor abandons the work, assigns or sublets the contract without consent, or willfully violates contract conditions, the town may declare the contractor in default and contract for completion, charging the expense to the contractor.
The town reserves the right to reject any bid or proposal from a bidder that appears on the prohibited entities list and to pursue a responsibility review with respect to any bidder that is awarded a contract and subsequently appears on the prohibited entities list.
