This solicitation is for fuel tenders to be used for fire suppression, all-hazard incidents, and prescribed fire projects across local, regional, and nationwide areas. The US Forest Service is issuing this Request for Quotes (RFQ) through the Virtual Incident Procurement (VIPR) Next Gen system. Contractors will be responsible for providing all equipment, personnel, and management necessary to meet specifications. The contract type will be multiple Blanket Purchase Agreements (BPAs) with a potential 5-year duration. Awards will be made to responsible quoters based on operational acceptability, price reasonableness, and past performance. The acquisition is solicited as a total small business set-aside, with additional consideration for socioeconomic status. Vendors must register in SAM. gov and have a login. gov account to participate. Quotes must be submitted electronically via the VIPR Next Gen vendor application, including detailed technical information and pictures of the equipment. The government reserves the right to conduct inspections. Payment will be made at rates in effect at the time of order issuance.
The agreement period is for 5 years from the date of award, with annual review modifications. Specific delivery deadlines for services will be determined at the time of order placement.
Payments will be made in accordance with the Prompt Payment Act and regulations at 5 CFR part **** will be at the rates specified in the agreement in effect at the time of the order. Lumpsum payment will normally be processed at the end of the emergency assignment, though partial payment may be authorized.
The contractor warrants and implies that the items delivered under this contract are merchantable and fit for use for the particular purpose described in this contract.
The government will award a sufficient number of BPAs anticipated to meet incident resource needs resulting from this solicitation to responsible quoters whose quotes conforming to the solicitation will be advantageous to the government, price and other factors considered.
BPAs will be awarded only to quoters with reasonably priced resources, operationally acceptable resources, and a low or unknown performance risk.
The government may terminate this contract, or any part hereof, for cause in the event of any default by the contractor, or if the contractor fails to comply with any contract terms and conditions, or fails to provide the government, upon request, with adequate assurances of future performance.
The government is planning prequote meetings, during which potential quoters may obtain a better understanding of the work required. Quoters are encouraged to submit all questions in writing at least five 5 days prior to the conference.
The contract is subject to 41 U. S. C. chapter 71, Contract Disputes. Failure of the parties to reach agreement on any request for equitable adjustment, claim, appeal, or action arising under or relating to this contract shall be a dispute to be resolved in accordance with the clause FAR ****, Disputes.
