The bid proposal submittal deadline is 10:00 AM on May 28, 2026.

The owner will pay the contractor monthly, ninety-five percent (95%) of the whole amount due the contractor for the amount of work which the engineer shall estimate as done up to the last day of that particular month. Payment of the estimated bill shall follow within thirty days after the receipt and approval of the estimate. The final 5% will be paid at the end of one year maintenance period.

The contractor guarantees the work done under this contract and the materials furnished by him and used in the work are free from defects, and the guarantee is for a term of one (1) year from and after the date of the certificate of project completion.

Award will be based on the bidders responsiveness to the requirements of this bid package, experience, past performance, and financial responsibility.

The owner may make such investigations as he deems necessary to determine the ability of the bidder to perform the work, and the bidder shall furnish to the owner all such information and data for this purpose as the owner may request.

Failure or refusal to execute the contract and required bonds within 10 days after receiving notice of acceptance shall cause the bidder to forfeit to the owner, as liquidated damages for such failure or refusal, the security deposited with his bid.

All disputes arising under this contract or its interpretation, whether involving law or fact or both, or extra work, and all claims for alleged breach of contract shall within ten (10) days of commencement of the dispute be presented by the contractor to the owner for decision.

It is anticipated that approximately $150,000 worth of assignments will be issued under this contract.

The bid notice states that partial payments may be made on materials for which advanced payment has been allowed, with the contractor required to pay suppliers within 30 days of the estimate on which the advanced payment was first allowed. Proof of payment must be verified by the supplier. If proof of payment is not furnished within the allowable 30 days, the advanced payment will be deducted on subsequent current estimates until such time that proof of payment is furnished.

The bid notice mentions that all manufacturers standard warranties and guarantees on pavement marking tape, which are provided as customary trade practice, shall be delivered to the engineer at the final inspection. All warranties and guarantees shall be made out to the department.

The bid notice states that a breach of any of the stipulations contained in the required contract provisions may be sufficient grounds for withholding of progress payments, withholding of final payment, termination of the contract, suspension, debarment, or any other action determined to be appropriate by the contracting agency and FHWA.

The bid notice states that for materials such as glass beads, thermoplastic marking material, pavement marking tape, raised pavement markers, and adhesive for pavement markers, the contractor shall furnish the engineer with a copy of the manufacturers certified test reports for the lots of materials from which the shipment originated. Acceptance sampling and testing will be in accordance with the materials division inspection, testing, and certification manual materials manual. Samples of the material shall be furnished and shall be provided at no cost to the state.
