The USPTO is conducting market research through a Request for Information (RFI) to identify vendors capable of providing AI solutions for fraud identification, suppression, and defeat, as well as for unsupervised AI and discovering impersonations in trademark examination. The goal is to enhance the integrity of the trademark register and prevent impersonations. Vendors must be FedRAMP certified or in the process of obtaining certification. The RFI outlines a multi-stage market research approach, including an industry survey (Stage One) with specific questionnaire responses due by May 6, 2026. The USPTO is exploring the use of advanced technologies like AI, ML, and NLP to augment current capabilities. Black box solutions will not be accepted, and all solutions must be transparent. The RFI also mentions the possibility of an alternative competition method under the Patent and Trademark Office Efficiency Act.
The deadline for all Stage One responses and RFI submissions is May 6, 2026.
The USPTO will review RFI responses to determine which vendors are most likely to successfully meet the agency's requirements for fraud impersonation AI, unsupervised AI, and discovering impersonations AI.
Vendors must provide AI/ML solutions that are FedRAMP certified or FedRAMP-ready and scalable. Vendors must submit their FedRAMP certification with their response. If a vendor does not have or is not seeking a FedRAMP certification, they are not eligible to participate in this RFI.
Questions regarding how to respond to the RFI or recommend changes to the RFI are due by 12 noon EST on Monday, April 20, 2026.
