The response deadline for proposals is May 8, 2026, at 12:00 PM CT.

The selected proposer shall pay the city a commission payment at least monthly, which must include a detailed itemization of food, beverage, event, and rental income.

The proposer expressly warrants that all goods supplied shall be merchantable and conform to specifications, drawings, and other descriptions, and shall be free from defects in materials and workmanship.

Proposals will be evaluated by an evaluation and selection committee based on a 101-point scale, with the highest scoring proposal recommended for award, subject to the best interests of the city. Criteria include compensation, history and experience, business plan, staffing, marketing, references, and local preference.

Proposers must clearly demonstrate and provide documentation substantiating that they are qualified and able to meet the requirements of this request for proposal to provide the services proposed.

In any case where the successful proposer has failed to deliver or has delivered nonconforming goods or services, the procurement division may provide a cure notice. If the proposer continues to be in default, the procurement division may procure goods or services from another source and charge the difference to the defaulting proposer, or offset such costs from payments owing to the proposer.

An optional pre-submission conference will be held in person at Simon Estes Riverfront Amphitheater on April 14, 2026, at 1:00 AM. Proposers must email the procurement representative by noon on April 13, 2026, to RSVP.

Proposer objections to the evaluation and selection committee's recommendation must be filed in writing with the procurement administrator within the appeal deadline set forth in the notice of intent to award.

The proposal submission deadline is April 1, 2026, at 12:00 p. m. CDT. The city requests product delivery to occur Monday through Friday no later than 1 pm.

The city's payment terms are net 30 days. The city is exempt from Missouri sales and use taxes.

The city reserves the right to select the vendor who best meets the overall needs of the City of O'Fallon based primarily on proposed items listed in the scope of services, cost, adherence to requested information specifications, thoroughness of the proposal, as well as the overall format of the presentation.

All companies shall be licensed, insured, and bonded and shall furnish satisfactory evidence to the city that they have previously performed/provided the types of services as specified. Company shall be eVerify compliant and shall provide documentation to support this requirement within the proposal including the Memorandum of Understanding (MOU) and the electronic signature page completed in its entirety.

If the city, because of the vendor's breach, terminates this contract, the city shall have the right to purchase service elsewhere and to charge the vendor with any additional cost incurred. Notwithstanding the above, the vendor shall not be relieved of any liability to the city for damages sustained by the city by virtue of any breach of this contract by the vendor and the city may withhold any payments to the vendor until such time as the amount of such damages due the city from the vendor shall be determined.

The deadline for submission of questions is March 25, 2026, at 12:00 p. m. CDT.

It is estimated that the annual gross sales for the city concession stands will be in excess of three hundred thousand dollars ($300,000) annually, however the city does not represent or guarantee the annual gross sales will reach any specified amount during any year.
